MENAKAR PARADIGMA KEIMIGRASIAN DI INDONESIA MELALUI ANALISIS UNDANG-UNDANG NO.6 TAHUN 2011 TENTANG KEIMIGRASIAN
Abstract
Kelembagaan dalam keimigrasian telah mengalami perubahan seiring dengan perkembangan isu keimigrasian dan dinamika dalam perpolitikan domestik maupun internasional. Reformasi dalam keimigrasian Indonesia ditandai dengan perubahan kebijakan opendeur politiek (politik pintu terbuka) menjadi selective policy (kebijakan selektif). Reformasi juga ditandai dengan lahirnya Undang-Undang No. 6 Tahun 2011 Tentang Keimigrasian. Penulisan ini bertujuan untuk menganalisa paradigma yang digunakan oleh pemerintah Indonesia dalam pembuatan kebijakan keimigrasian melalui analisis Undang-Undang No. 6 Tahun 2011. Penulis menggunakan metode content analysis dalam menganalisis undang-undang tersebut. Analisa dilakukan terhadap lima indikator; aktor, otoritas, anggaran, tata kelola, dan output yang mewakili tiga paradigma; realisme, liberalisme, dan konstruktivisme. Berdasarkan hasil analisis, Undang-Undang Keimigrasian sangat dipengaruhi oleh paradigma realisme.
